Part A. Terms and Conditions

These Terms and Conditions (these “Terms”) govern your use of CBAlexandra.com (the “Site”) and every purchase you make through it. The Site is operated by C.B. Alexandra LLC, a Florida limited liability company (“C.B. Alexandra,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. Our Privacy Policy in Part B explains how we handle your personal information; it is not part of these Terms. If you do not agree, do not use the Site.

Please read Section 5 before you order. Socks, tights, underwear, and the other close-fitting items listed in Section 5.1 are final sale.

1. Eligibility

You must be at least 18 years old, or use the Site with the permission and supervision of a parent or legal guardian who accepts these Terms for you. The Site is not directed to children under 13.

2. Products, Prices, and Discounts

2.1 Product Information. Colors may look different on your screen, and fit varies by body. Check the size information on each product page, and email us before ordering if you are unsure.

2.2 Prices and Taxes. Prices are in US dollars and do not include shipping or sales tax, which are shown at checkout. We collect sales tax where the law requires.

2.3 Errors. If a product is listed at the wrong price or with wrong information, we may cancel orders for it, even after we confirm them, and refund what you paid.

2.4 Discount Codes. Discount codes have no cash value, apply only as the offer states, and cannot be combined unless the offer says so. We may change or end an offer at any time, but not for an order already placed. We may cancel orders that use a code obtained or used improperly.

3. Orders and Payment

3.1 Acceptance. Your order is an offer to buy. Our order confirmation email confirms that we received it; we accept your order when we ship it. You may cancel your order by email until we ship it. We may limit quantities and may refuse or cancel any order, including for suspected fraud or purchases for resale. We will refund any amount charged for a canceled order.

3.2 Payment. You must use a payment method you are authorized to use. Third-party payment processors handle payments; we do not receive or store full card numbers.

4. Shipping

4.1 Destinations. We ship only to addresses in the United States.

4.2 Timing. Processing and delivery times shown on the Site are estimates. If we cannot ship your order within the processing time stated on the Site, or within 30 days if none is stated, we will notify you and let you choose between accepting the delay and canceling for a full refund.

4.3 Risk of Loss. Title and risk of loss pass to you when the carrier records the package as delivered to the shipping address you gave us. After that, a lost or stolen package is your responsibility, as is a package delivered to an incorrect address you provided. If tracking shows delivery but you cannot find the package, email us within 7 days and we will help you file a claim with the carrier. If a package is lost before the carrier records delivery, email us within 30 days after the estimated delivery date and we will replace the order or refund it, at our choice.

5. Returns and Final Sale

5.1 Final-Sale Items. The following items are final sale. They cannot be returned or exchanged, and they are not eligible for a refund except under Section 5.3:

(a) socks, tights, hosiery, and underwear;

(b) leotards, bodysuits, unitards, leggings, shorts, sports bras, gloves, and compression wear;

(c) skating, gymnastics, and dance dresses and skirts;

(d) any other item designed to be worn close against the skin;

(e) clearance items; and

(f) any item identified as final sale on its product page or at checkout.

5.2 Returnable Items. You may return any other item if it is unworn, unwashed, and unaltered, with its original tags and packaging. To start a return, email support@cbalexandra.com within 30 days after delivery, then ship the item within 10 days after we send instructions. Within 10 business days after we receive and inspect the item, we will refund the price you paid for it, after any discount, plus the tax on it, to your original payment method. We do not refund original shipping charges, and you pay return shipping unless the return results from our error. We do not offer exchanges; return the item and place a new order.

5.3 Limited Warranty. If any item, including a final-sale item, arrives defective, damaged, or different from what you ordered, contact us by email or mail at the addresses in Section 14 within 30 days after delivery, with your order number and photos of the problem. If we confirm the problem, we will replace the item or refund its price and the shipping you paid for it, at our choice, and we will pay for any return we require. Normal wear, and snags, runs, or holes caused by use (including contact with skate blades, lace hooks, or rough surfaces), are not defects. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

6. Use of Products

Our products are apparel and accessories, not protective equipment, and they are not designed to prevent injury. Figure skating, gymnastics, and other athletic activities carry risks that you accept. Follow the care instructions on each label.

7. Reviews and Other Submissions

7.1 Your Content. If you submit a review, photo, comment, or other material (“Your Content”), you grant us a non-exclusive, royalty-free, worldwide license, which we may sublicense and transfer, to use, copy, display, publish, crop, and format Your Content, with the name or username you submit, on the Site, on social media, and in our marketing. If you ask, we will remove Your Content from the Site and stop using it in new marketing. You confirm that Your Content reflects your own experience and that you have the right to share it.

7.2 Moderation. We do not remove or withhold reviews because they are negative. We may decline to post or may remove content that contains confidential information; is defamatory, harassing, abusive, obscene, vulgar, sexually explicit, or discriminatory; includes another person’s personal information or image without consent, or an image of anyone under 18; is clearly false or misleading; appears to be fake; or is unrelated to our products or service.

7.3 Incentives. Any discount or other reward we offer for a review does not depend on whether the review is positive or negative.

8. Intellectual Property

The Site and its content, including the C.B. Alexandra name and logo, our product designs, text, photographs, and graphics, belong to us or our licensors. You may view and print pages of the Site for your personal, noncommercial use. Any other use requires our written permission.

9. Use of the Site

You may not use the Site for any unlawful purpose, interfere with its operation or security, access it with bots, scrapers, or similar automated tools, or give us false information. We may suspend or end your access if you violate these Terms.

10. Limitation of Liability

10.1 The Site. We provide the Site “as is” and do not promise that it will be uninterrupted or error-free.

10.2 Limits. To the fullest extent the law permits, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from the Site or our products, and our total liability for any claim is limited to the amount you paid for the order that gave rise to the claim. This Section 10.2 does not limit liability for personal injury caused by our negligence, for fraud or willful misconduct, or for anything else the law does not allow us to limit. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

11. Disputes

11.1 Governing Law. Florida law governs these Terms and any dispute between you and us, without regard to its conflict-of-laws rules.

11.2 Venue. Any lawsuit between you and us must be brought only in the state or federal courts located in Palm Beach County, Florida, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in any small claims court with jurisdiction over it.

12. Changes to These Terms

We may change these Terms by posting the revised version on the Site with a new effective date. The Terms posted when you place an order govern that order.

13. General

These Terms are the entire agreement between you and us about the Site and your purchases. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor to our business. Headings are for convenience only.

If something goes wrong with an order, please contact us first so we can make it right. If you have trouble using the Site, email us and we will help you complete your order. We may give you notices at the email address you provide.

Part B. Privacy Policy

This Privacy Policy explains how C.B. Alexandra collects, uses, and shares personal information through the Site.

15. Information We Collect

15.1 Information You Give Us. Your name, email address, shipping and billing addresses, phone number, order history, messages to us, reviews and photos you submit, and your email address if you sign up for marketing emails. Our payment processors collect your payment card information; we do not receive or store full card numbers.

15.2 Information Collected Automatically. Your IP address, device and browser type, the pages you view, the website that referred you, and your activity on the Site, collected through cookies, pixels, and similar technologies used by us and our service providers.

16. How We Use Information

We use personal information to process, ship, and support your orders and returns; respond to you; send marketing emails if you sign up; send a reminder if you start checkout without finishing; publish reviews you submit; operate, secure, and improve the Site; prevent fraud; and comply with the law and enforce our Terms.

17. How We Share Information

We share personal information only:

(a) with service providers that help us run our business, including our e-commerce platform, payment processors, shipping carriers, and email, review, analytics, and advertising providers;

(b) when the law requires it, or to protect our rights, our customers, or others from fraud or harm;

(c) with a buyer or successor if our business is sold or transferred;

(d) with our professional advisers and insurers; and

(e) with your consent or at your direction.

Reviews you submit are public. We do not sell or rent your personal information for money.

18. Cookies and Tracking

Cookies keep the Site working (for example, your shopping cart) and show us how visitors use it. Our analytics and advertising providers may collect information about your online activities over time and across different websites when you use the Site. You can block or delete cookies in your browser settings, but parts of the Site may not work without them. The Site does not respond to browser “Do Not Track” signals.

19. Marketing Emails

If you sign up, we will send you marketing emails. Each one includes an unsubscribe link. Unsubscribing does not stop emails about your orders.

20. Your Requests

To review, correct, or delete your personal information, email support@cbalexandra.com. We will respond within a reasonable time. We may keep information we need to complete orders, keep business and tax records, prevent fraud, or comply with the law.

21. Retention and Security

We keep personal information only as long as we need it for the purposes in this Privacy Policy and to meet legal, tax, and accounting requirements. We use reasonable safeguards to protect it, but no website or data transmission is completely secure.

22. Children

The Site is not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child under 13 has given us personal information, contact us under Section 14 and we will delete it.

23. Changes to This Policy

We will post any change on this page and update the effective date. For a material change, we will also post a notice on the Site’s home page.
